1. Acceptance of Terms

By creating an account, accessing, or using the Ritz Pool Resort website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use our Services.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

2. Account Registration

You must provide accurate, complete, and up-to-date information during registration.
You are solely responsible for maintaining the confidentiality of your password and account credentials.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that contain false, misleading, or outdated information.
Accounts are non-transferable and may not be shared with others.

3. Bookings & Reservations

All bookings are subject to availability and confirmation by Ritz Pool Resort.
A booking is confirmed only when you receive a confirmation email or notification.
We reserve the right to cancel or modify bookings due to unforeseen circumstances (e.g., weather, maintenance, or operational issues).
Guests must present valid identification upon check-in matching the booking details.
Special requests (e.g., room preferences, dietary needs) are subject to availability and not guaranteed.

4. Payment & Fees

All prices are listed in Philippine Pesos (₱) and include applicable taxes unless otherwise stated.
Accepted payment methods: Cash on check-in, GCash, and bank transfers (details provided upon booking).
Full payment may be required at the time of booking for peak seasons or promotional rates.
Refunds and cancellations are subject to the cancellation policy (see Section 5).
Any additional charges (e.g., extra guests, room service, damages) will be settled upon check-out.

5. Cancellation & Refund Policy

Standard Cancellation: Free cancellation up to 24 hours before check-in. Cancellations within 24 hours will incur a charge equivalent to one night's stay.
No-Show: Guests who do not arrive without prior cancellation will be charged the full booking amount.
Early Departure: No refunds for early check-out.
Refund Processing: Approved refunds are processed within 3–5 business days via the original payment method.
Force Majeure: In the event of natural disasters, government restrictions, or other emergencies, we will offer full refunds or rescheduling options.

6. User Conduct

By using our Services, you agree NOT to:

Use the Services for any unlawful, fraudulent, or malicious purpose.
Interfere with or disrupt the operation of our website or booking system.
Access or attempt to access other users' accounts without authorization.
Upload or transmit viruses, malware, or any harmful code.
Engage in any activity that could damage, disable, or impair our infrastructure.
Violate the rights of other guests, staff, or third parties.

Violation of these conduct rules may result in immediate termination of your account and legal action if applicable.

7. Intellectual Property

All content on the Ritz Pool Resort website, including but not limited to text, graphics, logos, images, software, and designs, is the property of Ritz Pool Resort or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content without our express written permission.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

8. Limitation of Liability

To the fullest extent permitted by law, Ritz Pool Resort and its affiliates, directors, employees, or agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.
Loss of profits, data, or goodwill arising from your use of the Services.
Any injury, loss, or damage arising from the use of our facilities (except where caused by our gross negligence).
Service interruptions, technical errors, or unauthorized access to your data.

Our total liability for any claim arising from these Terms shall not exceed the total amount paid by you for the specific booking or service in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ritz Pool Resort, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Services.
Your violation of these Terms.
Your violation of any third-party rights or applicable laws.
Any content you submit or transmit through the Services.

10. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Grounds for termination include:

Violation of these Terms.
Fraudulent or illegal activity.
Non-payment of outstanding balances.
At our sole discretion to protect our business interests.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive (e.g., liability, indemnity, intellectual property).

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Boracay, Philippines.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ritz Pool Resort regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral.
